Greater Taree Local Environmental Plan 2010

Council has completed a comprehensive Local Environment Plan (LEP) under the Standard Instrument (Local Environmental Plans) Order 2006, known as the standard LEP template.
To help you understand the Local Environment Plan we have prepared a factsheet.

The LEP 2010 includes the written instrument and associated mapping, which now includes layers for:

  • Land zoning
  • Lot size;
  • Floor space ratio
  • Height of buildings
  • Heritage
  • Acid sulfate soils
  • Land reservation acquisition
  • Obstacle limitation surface;
  • Urban release area
  • Flood planning land and additional uses

Gazettal

The gazettal of the LEP 2010 repeals the Greater Taree LEP 1995 and the Manning LEP No. 1.

Applicants are advised to ensure that the proposed development is a permitted use within the zone applying to the site under the current Greater Taree Local Environmental Plan.

Minor Developments

Some minor development, known as ‘exempt development’ is permitted to be undertaken without the need for a development application. Applicants are to refer to the CODE SEPP (under NSW Housing and Industrial & Commercial Codes and the Schedule 2 Exempt Development within the LEP 2010 for the types and the limits and requirements of exempt development.

A range of frequently occurring minor development may be undertaken as ‘complying development’. Applicants are to refer to the CODE SEPP (under NSW Housing Code and Industrial & Commercial Code and Schedule 3 Complying Development within the LEP 2010 for the range of development and the associated limits and requirements of complying development. These applications are lodged under a complying development application.

Flood Planning

The new LEP 2010 now incorporates a Flood Planning Land Mapping layer. The Flood Planning Land Mapping factsheetprovides an explanation on the representation and use of the flood planning land data within the LEP 2010.

Amendments to the LEP

Council is undertaking a number of major projects that will lead to LEP Amendments.
