Development

What is Development?

Development is defined by the Environmental Planning and Assessment Act 1979 as:

  • the use of land;
  • the subdivision of land;
  • the erection of a building;
  • the carrying out of a work;
  • the demolition of a building or work; and
  • any other act, matter or thing referred to in section 26 that is controlled by an environmental planning instrument

Development Services

Development Services is responsible for providing advice regarding the use and development of land. Assess and determine development proposals, monitor the development and use of land and investigate unauthorised uses.

Objectives:

The orderly development and use of land consistent with Council's responsibilities under the Environmental Planning and Assessment Act 1979, related legislation and Council's own policies, codes and development control plans.

To inform the community regarding statutory requirements and Council policies and opportunities in relation to the use, development and management of land.

Development & Building Process

Thinking of building or developing? You need to establish what you may build on your land, and if you need Council consent to do so. Below details the steps involved in the development application process.

Preliminary Consultation & Preparation

  • Research your proposal and/or complete your development application form.
  • Have a question? Contact our Customer Service Centre on 6592 5399.
  • Organise a pre-lodgement meeting (usually for major applications).

Political Donations

As from 1 October 2008, anyone lodging or commenting on a development application, Local Environmental Plan (LEP) or Development Control Plan (DCP) is required to publicly disclose any donations or gifts that are relevant to the proposal. This law has been introduced by the state government to improve the transparency of the planning system.

The disclosure requirements apply at the time the application is lodged with any Council or the NSW government, and also apply to individuals or entities lodging submissions in objection or support of the proposal. It is the responsibility of every person to ensure that they comply with any obligations under the disclosure requirements.

  • Political Donations and Gifts Disclosure Statements are required by statute. The form in which the information is collected accords with the requirements of the Environmental Planning and Assessment Act 1979. All Political Donations and Gifts Disclosure Statements will be public documents and all information contained in them will be available to the public and government agencies.

Notification & Submissions

  • Council will notify adjoining property owners (note: unless complying development).
  • Undertake internal and external referrals.
  • Consider submissions.
  • Provide progress of your application through Application Tracking on the website.

Assessment

  • Undertake a site inspection.
  • Complete formal assessment using relevant legislation.
  • Liaise with applicant/s.
  • Consider amendments to design.
  • Complete assessment with recommendation for approval or refusal.

Determination

  • A delegated officer or the elected Council will make the decision.
  • Written notice is provided to applicant and objectors.
  • Applicant may seek a review of determination; or appeal to the Land and Environment Court.

Post Determination

Construction Certificate

  • Appoint a Principal Certifying Authority (if not already appointed).
  • Obtain a Construction Certificate from Council or another accredited certifier, before work commences (if not already obtained).
  • Ensure all construction plans and specifications comply with the Building Code of Australia.

Development Commencement

  • Lodge Notice of Commencement at least 2 days prior to commencing works.
  • Undertake construction in accordance with your approved plans and conditions.
  • Ensure mandatory inspections are undertaken and certified by the Principal Certifying Authority.

Development Occupation/Use

Council will:

  • Undertake final inspection
  • Issue an Occupation Certificate (Interim/Final).
  • Issue orders and/or penalty notices for any non-compliance with approved plans.
  • Undertake ongoing monitoring of development consent/approval.
